FACILITY RENTAL TERMS AND CONDITIONS

TERMS AND CONDITIONS OF FACILITIES RENTAL

1. FIRST ASSEMBLY CHURCH CONTACT  - All communication from the Applicant to First Assembly Church (hereafter referred to as FA) shall be directed to the Facilities Booking Coordinator (Claire Iffla: claire.iffla@fa.church)

2. RESPONSIBILITY FOR DAMAGES AND SECURITY DEPOSIT - The applicant is responsible for all damage to the facility and any equipment utilized (reasonable use excepted) occurring as a result of the Applicant's rental. Actions causing a false fire alarm by activating a pull station will result in all fines/costs ($1000) incurred from the Fire Department being charged to the applicant. The Applicant shall provide a booking deposit of 50% of the estimated total rental to reserve event booking.

3. COMPLIANCE WITH REGULATIONS - The Applicant agrees to comply with all building and fire regulations for the event and to comply with any facility rules adopted by FA for the facility. Flying equipment is not authorized.  Confetti and silly string is prohibited from use on facility site.

4. USAGE BY FIRST ASSEMBLY CHURCH - By renting the facility to the Applicant, FA in no way relinquishes its right to control the management of the facility and to enforce all necessary rules and regulations as may be required. FA may use other components of the facility during the event that does not materially interfere with the usage by the Applicant. FA retains the right to alter or terminate any booking that is incompatible with any unforeseen congregational usage requirements of the church, provided that the church shall use its best efforts to facilitate the Applicant on other dates or in other components of the facility in such circumstances. 

5. PROHIBITED ACTIVITIES IN THE FACILITY - The Facility has been designated as a non-smoking and alcohol-free building. Also, First Assembly may from time to time restrict food and beverages in certain areas of the Facility. First Assembly Church is a Pentecostal Church, associated with the Pentecostal Assemblies of Canada. First Assembly Church will not rent the Facility to any group whose constitution or intended usage of the Facility contravenes the Statement of Faith of First Assembly (available online at www.fa.church) as interpreted by the Board of First Assembly Church. In the case that the event, or any component thereof, is determined by First Assembly Church to contravene the Statement of Faith, First Assembly Church shall terminate the booking and return payment/deposit in full to the Applicant without any further liability to either party.

6. PAYMENT - A deposit of 50% of fees are due to secure the event. The balance of fees are due 24hrs before the event begins.

7. CANCELLATION - First Assembly Church will refund 50% of the booking deposit for all events cancelled with more than 30 days notice. The booking deposit will not be refunded with notice of less than 30 days.

8. OPERATION OF SOUND AND VISUAL MEDIA EQUIPMENT - Only First Assembly Church trained Audio Technicians shall be allowed to operate the sound system in the Auditorium. All set up and tear down for all Audio/ Visual systems in the building will be done by the First Assembly Technical Department. (Not limited to, but including: The Portable Sound System, Digital Projectors, TVs, DVDs, Overhead Projector and Screen in all rooms of the Facility). Applicants who are using and operating these pieces of equipment shall comply in all respects with the operational guidelines provided by First Assembly Church.

9. WIFI SERVICES - The aim of First Assembly Church is to provide Wi-Fi connections which are reliable, however, errors and technical problems may occur or develop. First Assembly Church makes no warranties or representations of any kind, either express or implied, that the Wi-Fi functions or services provided will be error-free or without defect. First Assembly will not be responsible for any loss, damages, or expense as a result of a potential FA Wi-Fi network failure or outage.

10. MUSIC LICENSING - The Applicant is responsible for any and/or all licenses that are required to play and/or perform music for revenue generated events held at FA. (see Socan.ca for more information)

11. DECORATIONS - All decorating to be completed for the event shall be the sole responsibility of the Applicant. No decoration shall be fastened to the wall of the Facility or otherwise affixed in such a manner that will damage the Facility. Tear-down and clean-up of decorations is also the responsibility of the Applicant. 

12. KITCHEN SERVICES - No outside caterers or food service providers will be permitted use of the First Assembly Church kitchen without prior approval and proof of Food Safety Certification. For approval, please provide the company name, proof of license, address, phone number and a contact name to the Booking Coordinator.

13. WAIVER OF LIABILITY -  By executing this document, the Applicant agrees that it will not hold First Assembly Church, its board or its employees responsible for any medical or personal injury, or any other loss or damage and hereby waives any claim against First Assembly Church. The Applicant acknowledges that it is its responsibility to take the necessary steps for insuring against personal injury, loss, property damage, or any other loss of damage that might be incurred by us or the people at the Facility during the event.

14. INDEMNITY - The Applicant hereby agrees to indemnify and hold harmless First Assembly Church, its officers, agents and employees, of and from all demands, claims, suits, actions or liabilities resulting from injuries or death to any person or from any property damage occurring during the event.

15. AUTHORIZATION FOR TREATMENT - In the event of injury or illness, the Applicant authorizes First Assembly Church personnel, staff or designates to seek and obtain such emergency or medical services for people as may be deemed necessary at the time.

16. BINDING EFFECT - This document shall constitute the sole and entire agreement between the parties and is intended to create legal obligations. The undersigned hereby warrants that it has authority to bind the Applicant as per the Terms and Conditions hereof. This document shall not be of any effect unless executed by both parties.

17. COUNTERPART - This document may be executed via counterpart signature.
